{"id":3650,"date":"2014-05-01T09:59:11","date_gmt":"2014-05-01T15:59:11","guid":{"rendered":"http:\/\/valleywatch.net\/?p=3650"},"modified":"2014-05-01T09:59:11","modified_gmt":"2014-05-01T15:59:11","slug":"duke-energys-clean-coal-plant-coughed-wheezed-in-february","status":"publish","type":"post","link":"http:\/\/valleywatch.net\/?p=3650","title":{"rendered":"Duke Energy&#8217;s Clean Coal Plant Coughed, Wheezed in February"},"content":{"rendered":"<p><strong>May 1, 2014-by Paul Chesser in the <a href=\"http:\/\/nlpc.org\/stories\/2014\/04\/29\/duke-energys-clean-coal-plant-coughed-wheezed-feb\">National Legal and Policy Center<\/a>. <em>Editor&#8217;s note: Valley Watch has been an intervener in every one of what is now thirteen &#8220;dockets&#8221; before the IURC regarding this plant.\u00a0<\/em><\/strong><\/p>\n<p><a href=\"http:\/\/valleywatch.net\/wp-content\/uploads\/2014\/05\/Dupe-Energy-Logo-dirty.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-3652\" src=\"http:\/\/valleywatch.net\/wp-content\/uploads\/2014\/05\/Dupe-Energy-Logo-dirty.jpg\" alt=\"Dupe-Energy-Logo-dirty\" width=\"400\" height=\"200\" srcset=\"http:\/\/valleywatch.net\/wp-content\/uploads\/2014\/05\/Dupe-Energy-Logo-dirty.jpg 533w, http:\/\/valleywatch.net\/wp-content\/uploads\/2014\/05\/Dupe-Energy-Logo-dirty-300x150.jpg 300w\" sizes=\"auto, (max-width: 400px) 100vw, 400px\" \/><\/a>After the\u00a0<a href=\"http:\/\/nlpc.org\/category\/keywords\/global-warming\">global warming<\/a>-battling<a href=\"http:\/\/nlpc.org\/category\/keywords\/edwardsport\">Edwardsport<\/a>\u00a0<a href=\"http:\/\/nlpc.org\/category\/keywords\/coal-gasification\">coal gasification<\/a>\u00a0power plant<a href=\"http:\/\/nlpc.org\/stories\/2014\/03\/25\/duke-energys-clean-coal-plant-uses-more-energy-it-produces\">used more power than it generated<\/a>\u00a0during the September-to-November timeframe, earlier this month information filed with the\u00a0<a href=\"http:\/\/nlpc.org\/category\/keywords\/indiana\">Indiana<\/a>Utility Regulatory Commission showed the<a href=\"http:\/\/nlpc.org\/category\/keywords\/duke-energy\">Duke Energy<\/a>\u00a0facility\u00a0<a href=\"http:\/\/www.indystar.com\/story\/money\/2014\/03\/31\/edwardsport-power-plant-hits-new-monthly-production-low\/7134481\/\">operated at less than 1 percent of capacity<\/a>\u00a0in February.<\/p>\n<p>As Duke wants to recover $1.5 million in costs related to the plant, the state office that advocates for its customers \u2013 the Office of the Utility Consumer Counselor \u2013 wants IURC to more closely scrutinize why Edwardsport\u2019s operation has been such a miserable failure. The much-delayed and fought-over plant had a $1.4 billion cost overrun and as a result is adding an average 16 percent increase to Hoosier State customers\u2019 electric bills.<\/p>\n<p>\u201cThe ratepayers of Duke Energy should not be mandated to bear the risks and most of the costs of this boondoggle,\u201d said Kerwin Olson, executive director of Citizens Action Coalition, to the\u00a0<em>Indianapolis Star<\/em>. Olson\u2019s organization has been a longtime critic of Duke Energy and the Edwardsport project specifically.<\/p>\n<p>Duke has\u00a0<a href=\"http:\/\/www.ibj.com\/state-green-lights-deeper-look-into-fuel-costs-at-edwardsport-plant\/PARAMS\/article\/47070\">argued<\/a>\u00a0that it would need 15 months for the plant to become fully operational. According to the\u00a0<em>Indianapolis Business Journal<\/em>, after the three-month blunder late last year, power production \u201c<a href=\"http:\/\/www.ibj.com\/dukes-edwardsport-plant-slows-to-crawl-in-january\/PARAMS\/article\/46478\">slowed to a crawl<\/a>\u201d in January due to mechanical problems. The company claimed it moved up planned routine maintenance to February, which extended its period of diminished activity.<a href=\"http:\/\/valleywatch.net\/wp-content\/uploads\/2014\/05\/IGCC.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-3651\" src=\"http:\/\/valleywatch.net\/wp-content\/uploads\/2014\/05\/IGCC.jpg\" alt=\"IGCC\" width=\"288\" height=\"117\" \/><\/a><\/p>\n<p>\u201cIt\u2019s a large, complex project, and it has taken time to work out technical issues,\u201d said Duke spokeswoman Angeline Protogere to the\u00a0<em>IBJ<\/em>.<\/p>\n<p>For the customers there is a huge difference between attaching the cost of Edwardsport\u2019s \u201cissues\u201d to its initial construction costs vs. charging for ongoing maintenance. A settlement limited the costs of the build-up of the plant for customers to $2.6 billion, while Duke\u2019s shareholders are responsible for $900 million. But now that Edwardsport is officially \u201conline,\u201d critics fear that repairs and maintenance that should be charged against the original design of the plant, will instead be added as new costs for customers under ongoing upkeep.<\/p>\n<p>Those representing the grassroots of Indiana don\u2019t appear to want to cut Duke any slack. Olson has been unrelenting, and in early 2012 the Office of Utility Consumer Counselor\u00a0<a href=\"http:\/\/nlpc.org\/stories\/2012\/05\/08\/duke-power-plant-boondoggle-cost-customers-plenty\">sharply criticized<\/a>\u00a0the utility\u00a0<a href=\"http:\/\/www.indystar.com\/article\/20120501\/BUSINESS\/205010324\/Deal-will-require-Duke-absorb-most-extra-cost-Edwardsport-plant?odyssey=mod%7Cnewswell%7Ctext%7CIndyStar.com%7Cs\">as<\/a>\u00a0\u201ca company that, through arrogance or incompetence, has unnecessarily cost ratepayers millions of dollars and has set back the public\u2019s trust in our regulatory process.\u201d An OUCC official testified, \u201cThere appears to be a lack of responsibility or accountability on the part of those causing these multimillion-dollar cost overruns.\u201d<!--more--><\/p>\n<p>Another ugly aspect of Edwardsport\/Indiana appears to be drawing to an end. As the saga played out over who would be responsible for cost overruns, David Hardy \u2013 the chairman of the IUCC appointed by then-Gov. Mitch Daniels \u2013 was revealed to have been meeting with Duke secretly to discuss problems at the power plant. Daniels fired Hardy after it was also disclosed that he knew that an IURC administrative lawyer was discussing a job with Duke while he participated in cases regarding Edwardsport. Hardy was indicted in 2011, but last year a judge ruled his actions no longer amounted to a crime, and yesterday the state Court of Appeals confirmed his decision despite the fact that they applied a law to Hardy\u2019s situation that wasn\u2019t passed until a year after his actions,<a href=\"http:\/\/www.usatoday.com\/story\/news\/2014\/04\/29\/court-throws-criminal-charges-former-regulator-duke-energy-case\/8461213\/\">according to the\u00a0<em>Star<\/em><\/a>.<\/p>\n<p>The track record for holding Duke Energy and government officials accountable for carelessness, ethics breaches and outright performance failures is not inspiring \u2013 especially in Indiana. The same Court of Appeals dumped the bulk of the Edwardsport costs also on its blameless customers. Meanwhile government know-nothings and former Duke CEO<a href=\"http:\/\/nlpc.org\/category\/people\/james-rogers\">James Rogers<\/a>\u00a0pushed for an ill-conceived project all for the purpose of reducing life-giving carbon dioxide, which is blamed for global warming.<\/p>\n<p>Undoubtedly such folly would not have happened \u2013 or at least have been tolerated \u2013 in a truly competitive free market.
