Photo \u00a9 2003 BlairPhotoEVV.<\/p><\/div>\n<p><span style=\"color: #000000;\">Trump administration officials are making plans to order grid operators to buy electricity from struggling coal and nuclear plants in an effort to extend their life, a move that could represent an unprecedented intervention into U.S. energy markets.<\/span><\/p>\n<p><span style=\"color: #000000;\">The Energy Department would exercise emergency authority under a pair of federal laws to direct the operators to purchase electricity or electric generation capacity from at-risk facilities, according to a memo obtained by Bloomberg News. The agency also is making plans to establish a &#8220;Strategic Electric Generation Reserve&#8221; with the aim of promoting the national defense and maximizing domestic energy supplies.<\/span><\/p>\n<p><span style=\"color: #000000;\"><a style=\"color: #000000;\" href=\"https:\/\/www.documentcloud.org\/documents\/4491203-Grid-Memo.html\" target=\"_blank\" rel=\"nofollow noopener\"><em>[Read the memo here]<\/em><\/a><\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cFederal action is necessary to stop the further premature retirements of fuel-secure generation capacity,\u201d says a 41-page draft memo circulated before a National Security Council meeting on the subject Friday.<\/span><\/p>\n<p><span style=\"color: #000000;\">The plan cuts to the heart of a debate over the reliability and resiliency of a rapidly evolving U.S. electricity grid. Nuclear and coal-fired power plants are struggling to compete against cheap natural gas and renewable electricity. As nuclear and coal plants are decommissioned, regulators have been grappling with how to ensure that the nation\u2019s power system can withstand extreme weather events and cyber-attacks<\/span><\/p>\n<p><span style=\"color: #000000;\">Although the memo describes a planned Energy Department directive, there was no indication President Donald Trump had signed off on the action nor when any order might be issued. The document, dated May 29 and distributed Thursday, is marked as a &#8220;draft,&#8221; which is &#8220;not for further distribution,&#8221; and could be used by administration officials to justify the intervention.<\/span><\/p>\n<p><span style=\"color: #000000;\">While administration officials are still deciding on their final strategy &#8212; and may yet decide against aggressive action &#8212; the memo represents the Energy Department\u2019s latest, most fully developed plan to intervene on behalf of coal and nuclear power plants, pitched to the president\u2019s top security advisers.<\/span><\/p>\n<p><span style=\"color: #000000;\">Energy Department representatives did not respond to an emailed request for comment.<\/span><\/p>\n<p><span style=\"color: #000000;\"><strong>Always-On<\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\">Trump administration officials who advocate taking action say they want to preserve nuclear and coal-fired plants that have fuel on site and provide reliable, always-on power capable of snapping back after intense storms and emergencies.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8220;Too many of these fuel-secure plants have retired prematurely and many more have recently announced retirement,&#8221; only to be replaced by less-secure, less-resilient natural gas and renewable power sources, the memo said.<\/span><\/p>\n<p><span style=\"color: #000000;\">Over dozens of pages, the memo makes the case for action, arguing that the decommissioning of power plants must be managed for national security reasons and that federal intervention is necessary before the U.S. reaches a tipping point in the loss of essential, secure electric generation resources. U.S. <a style=\"color: #000000;\" title=\"Company Overview\" href=\"https:\/\/www.bloomberg.com\/quote\/0219682Z:US\">Defense Department<\/a> installations are 99 percent dependent on the commercial power grid, one reason that electric system reliability is vitally important to national defense and homeland security, the memo asserts.<\/span><\/p>\n<p><span style=\"color: #000000;\">For two years, the Energy Department would direct the purchase of power or electric generation capacity from a designated list of facilities \u201cto forestall any future actions toward retirement, decommissioning or deactivation,\u201d according to the memo. The proposed Energy Department directive also would tell some of those facilities to continue generating and delivering electric power according to their existing or recent contracts with utilities.<\/span><!--more--><\/p>\n<p><span style=\"color: #000000;\">The department\u2019s intervention is meant to buy time for a two-year study of vulnerabilities in the American energy delivery system &#8212; from power plants that provide electricity to the natural gas pipelines that supply them. According to the memo, the planned action is a &#8220;prudent stop-gap measure&#8221; while the department addresses the nation\u2019s &#8220;grid security challenges.&#8221;<\/span><\/p>\n<p><span style=\"color: #000000;\">The Trump administration is moving to embrace two rarely used authorities under federal law to take the action, after weighing a <a style=\"color: #000000;\" title=\"Trump Said to Mull 2015 Grid Emergency Law to Save Coal Plants\" href=\"https:\/\/www.bloomberg.com\/politics\/articles\/2018-05-16\/trump-said-to-mull-2015-grid-emergency-law-to-save-coal-plants\" target=\"_blank\" rel=\"noopener\">broad array<\/a> of strategies for preserving coal and nuclear power plants.<\/span><\/p>\n<h3><span style=\"color: #000000;\"><strong>Cold War-Era Authority<\/strong><\/span><\/h3>\n<p><span style=\"color: #000000;\">The Energy Department would be relying partly on the Federal Power Act &#8212; the so-called Section 202 authority &#8212; that lets the administration order guaranteed profits for power plants that can store large amounts of fuel on site. Nationwide, BNEF said, two dozen nuclear plants &#8212; representing nearly 33 gigawatts &#8212; are either scheduled to close or probably won\u2019t make money through 2021.<\/span><\/p>\n<p><span style=\"color: #000000;\">The issue is a priority for some of the president\u2019s top supporters, including coal moguls Robert E. Murray and Joseph Craft of <a style=\"color: #000000;\" title=\"Company Overview\" href=\"https:\/\/www.bloomberg.com\/quote\/ARLP:US\">Alliance Resource Partners<\/a>, who donated a million dollars to the president\u2019s inauguration. The move would be one of the most direct efforts by Trump to make good on campaign promises to revive the nation\u2019s shrinking coal industry.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cThis action is essential in order to protect the resiliency and reliability of our nation\u2019s electric power grids,\u201d Murray said Friday in an email.<\/span><\/p>\n<p><span style=\"color: #000000;\">Trump administration officials have contemplated action for more than a year. After the Energy Department conducted a <a style=\"color: #000000;\" title=\"U.S. Lays Groundwork for Saving Coal Plants With Grid Report (1)\" href=\"https:\/\/www.bloomberg.com\/news\/articles\/2017-08-24\/perry-lays-groundwork-for-rescuing-u-s-coal-with-grid-report\" target=\"_blank\" rel=\"noopener\">reliability study<\/a> last year, Energy Secretary Rick Perry proposed a rule that would have compensated coal and nuclear plants for their ability to store months\u2019 worth of fuel on site. Federal regulators <a style=\"color: #000000;\" title=\"White House Plan to Help Coal Shot Down by Trump Appointees (1)\" href=\"https:\/\/www.bloomberg.com\/politics\/articles\/2018-01-08\/perry-plan-to-help-coal-nuclear-plants-rejected-by-regulators\" target=\"_blank\" rel=\"noopener\">shot down the idea <\/a>in January.<\/span><\/p>\n<p><span style=\"color: #000000;\">That didn\u2019t quell requests for help. A FirstEnergy Corp. subsidiary requested <a class=\"terminal-news-story\" style=\"color: #000000;\" title=\"FirstEnergy Raising Stakes in Plea for Bailout of Nuclear, Coal\" href=\"https:\/\/www.bloomberg.com\/news\/terminal\/P6D1086JTSE9\" target=\"_blank\" rel=\"noopener\">immediate intervention<\/a> from Perry\u2019s agency in late March. They argue there are many ways to back up the grid that won\u2019t cost ratepayers billions of dollars. A coalition of natural gas and renewable power advocates told Perry that \u201cpower plant retirements are a normal, healthy feature of electricity markets,\u201d and therefore there is no emergency that would justify Energy Department action.<\/span><\/p>\n<p><span style=\"color: #000000;\">Representatives of FirstEnergy did not immediately respond to emails seeking comment.<\/span><\/p>\n<p><span style=\"color: #000000;\">Invoking national security concerns could bolster the Trump administration\u2019s case in any legal challenges over the intervention, said Ari Peskoe, director of the Electricity Law Initiative at Harvard University.<\/span><\/p>\n<p><span style=\"color: #000000;\">&#8220;It\u2019s going to be tough to get a court to question DOE\u2019s factual finding &#8212; particularly if it relates to national defense,&#8221; Peskoe said in an interview. Tapping two statutes simultaneously also could give the administration more &#8220;legal room,&#8221; Peskoe said.<\/span><\/p>\n<p><span style=\"color: #000000;\">The Energy Department can invoke its Section 202 authority under the Federal Power Act after determining a grid emergency exists because of spiking demand, electric shortages or other issues.
